Russian Stores/Services - Updates regarding how sanctions impact deliveries and collections
Due to recent international sanctions implemented with respect to certain Russian individuals and entities, Too Lost is now updating our users in regards to the current statuses of certain digital service providers. These providers include United Media Agency (UMA), Yandex and SberZvuk.
United Media Agency (UMA):
Too Lost has been advised to cease all new deliveries of content to UMA immediately. Those who have previously distributed to UMA are NOT required to takedown any content. Royalties for reporting months up to December 2021 have been paid to users. However, after extensive legal advisory, Too Lost is unable to invoice and collect from UMA from reporting months January 2022 onwards, until further notice.
About United Media Agency (UMA): UMA is a B2B provider of technology, licensing and infrastructure. United Media Agency is part of the Mail.ru Group, whis is one of the largest email providers in Russia, the CIS and Georgia. Mail.ru is also the owner of the three most popular social media networks in Russia which are, Vkontakte (VK), Odoklassniki (OK), and Moi Mir (MM) also known as “My World.”
Yandex:
Too Lost has ceased further deliveries to Yandex. Royalties for reporting months up to November 2021 have been paid to users. We will update users with respect to the payment of reporting months December 2021 and onwards as soon as we have more information.
About Yandex: Yandex (https://www.yandex.com) is one of the largest technology companies in Russia and offers a number of internet related services and products. Yandex offers one of the most popular search engines in Russia and the Commonwealth of Independent States (CIS), in addition to its taxi, e-commerce, payment, and education services. Yandex operates primarily in Russia, the CIS and Turkey and is listed on the NASDAQ and Moscow exchanges (YNDX). Yandex has also operated, since 2010, an on-demand subscription and ad-supported streaming service “Yandex Music” (https://music.yandex.ru) (the “Service”) that is available on both desktop and mobile devices.
SberZvuk:
Based on the information currently available to us, we now believe that SberZvuk is a sanctioned entity under one or more sanction regimes relevant to Too Lost. Consequently, we have been advised that in such circumstances we are under an obligation to cease all new deliveries of content to SberZvuk with respect to the Too Lost / SberZvuk Agreement with immediate effect. Please note that at this stage, the advice we have received is that users are not required to take down content previously delivered to SberZvuk. We will however update users with further instructions should this position change. We are currently assessing the legal position on how to treat the payment of royalties, and will update users accordingly.
About SberZvuk: SberZvuk (https://sber-zvuk.com/) is a music streaming service available in Russia and CIS territories. Previously known as ‘Zvuk’ and ‘Zvooq’, the service was acquired by one of Russia’s largest banks, SberBank, and rebranded and relaunched in September 2020 as ‘SberZvuk’. SberZvuk intends to make the Service available to certain parts of SberBank’s customer base (currently over 54 million) via the SberPrime Bundle as described further below.
Upon a potential resolution of these sanctions and a notice from our legal teams, we will proceed to deliver all pending releases to Russian platforms, including the releases held in queue during this period. We will keep you updated as we learn more.
